International Dispute Resolution

A dispute in an international setting is always associated with more challanges including higher costs, a language barrier, foreign law and customs and limited enforceability. By far the best way to tackle these obstacles, is to avoid the court proceeding in a foreign state alltogether. There are several procedures, like facilitation, mediation or abitration, that are much better designed to manage international conflicts, each of these can save you thousands (sometimes hundreds of thousands) of euros and years of stress and waiting for a final decision compared to traditional litigation. Another advantage is that you do not need to hire a local attorney to represent your interest, which might come with issues of its own. You need an experienced international business lawyer and negotiater who is familiar with procedural rules at international arbitration courts and who will be able to reach a reasonable solution with the other party.

 

 

Some of the typical features of international conflicts are:

 

– which law (of which country) will apply on the case

– which country will have the jurisdiction over the case

– how can a judgment of a foreign court or an arbitration award be executed in other country

– which lawyer (of which state) can represent you during the litigation or arbitration

– which other institutions (beside the national courts and arbitration centers) are there to assist you to settle an international business disputes (e.g. Chambers of Commerce, embassies or various governmental agencies)

  • in mediation about the delivery of defective mechanical parts from a Czech manufacturer to a German tech giant
  • in arbitration to collect debt for a Swiss creditor from a debtor based in Montenegro
  • in litigation a between a Dutch investor and Czech municipality about the construction of biogas powerplants
